Alcala-Alcossebre Council is cautiously valuing the ruling which annuls PATIVEL and is calling on the Generalitat Valenciana for talks
The Comunitat Valenciana Superior Justice Tribunal has declared as void the Territorial Green Shore Infrastructure Plan of Action (PATIVEL) for the Comunitat Valenciana approved by the Generalitat Valenciana in May 2018. The ruling considers the appeal presented by a company and declares PATIVEL as void when taking into consideration, among other things, that it does not have an economic-financial study which reflects the costs of implementation and the economic repercussion which involves the affected properties and the municipalities which will have to develop it, nor does it foresee the heritage responsibilities which it could bring for the autonomous Administration for declassifying the land”.
Alcala-Alcossebre Council is viewing the ruling with caution, in the hope that it resolves the appeal presented by the council itself, but in ruling there appear the arguments complained of by the Council, so that it is to be hoped that it is equally valued. The council, now is studying how the voiding of PATIVEL might affect the town planning actions and infrastructures which were pending, such as the installation of street lighting in Capicorb.
Mayor Francisco Juan has indicated that “as we always maintained, the Generalitat Valenciana has to sit down to talk with owners and affected municipalities and to make a PATIVEL for everyone, in which the environment is protected but which, at the same time guarantees sustainable development and without punishing the owners”.
