Ciutadans per Capicorb and Gecen are asking the office of the public prosecutor for the immediate paralysation of the illegal work in sector P23 of the PGOU for Alcala de Xivert

Development works have invaded Dominio Público Maritimo Terrestre and Dominio Público Hidráulico with no authorisation from Costas nor from the Júcar Hydrographic Confederation, concrete has been laid within the protected limits of the Capicorb Tower; The Environment Department has not authorised any action whatsoever within the wetland protected boundary listed as “The Mouth of the Cuevas River” which is where the development is, this urbanisation is physically in the flood risk zone according to PATRICOVA and the Department has issued no approval nor is there any report in existence, authorising the work; no compulsory study of the landscape has been carried out; the development works have occupied the complete route of the Cañada Real de la Marina along the front section of sector P-23, including asphalting it with no authorisation whatsoever, etc.
A whole series of inappropriate works which are destroying the protected wetland, the historic heritage and placing the belongings and people in danger who could live in the buildings now in progress, with the obvious risk of flooding.
Departments which do not reply and let this happen, a Council submissive to development interests and a Justice on whose door we are continually knocking in the hope that it will paralyse such an inappropriate action once and for all.
In March this year a complaint was presented to the Office of the public prosecutor and due Diligence of Penal Investigation 192/2012 was opened. Now we have sent all sorts of new documentation which further endorses the illegality of the works and we asked that they should now be paralysed. However, work continues and we note how the offender is continuing with the work whilst residents and environment ONGs can see how they are destroying the protected areas, how the right is functioning and the total lack of compliance with the legislation.
